1. Agreement to Terms
By accessing or using Certflo ("the Service"), operated by Mesquite Dev LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Certflo is a web-based compliance document management platform for motor carriers. The Service allows users to upload, track, and export Driver Qualification Files and related documents as described in 49 CFR Part 391. Certflo is not a legal compliance advisor, does not provide legal advice, and does not guarantee regulatory compliance.
3. Compliance Disclaimer
Informational Use Only. The Certflo service, including all templates, checklists, alerts, and exports, is provided for informational and organizational purposes only. It does not constitute legal, compliance, or regulatory advice.
No Endorsement. Certflo is not endorsed by, approved by, affiliated with, or sponsored by the Federal Motor Carrier Safety Administration (FMCSA), the U.S. Department of Transportation (DOT), the Pipeline and Hazardous Materials Safety Administration (PHMSA), the Occupational Safety and Health Administration (OSHA), the Environmental Protection Agency (EPA), or any other government agency. References to federal regulations (including but not limited to 49 CFR Part 391) are provided as factual citations and do not imply any government endorsement of Certflo.
Customer Responsibility. Customer is solely responsible for compliance with all applicable federal, state, and local laws and regulations, including without limitation the Federal Motor Carrier Safety Regulations (49 CFR Parts 380, 382, 383, 390, 391, 392, 395, and 396) and related hazmat, workplace safety, and environmental rules. Customer is solely responsible for the accuracy and completeness of all data entered into Certflo and for all actions taken in reliance on Certflo output.
No Warranty of Compliance Outcomes. Certflo makes no representation or warranty that use of the service will result in compliance with any law or regulation, or that Customer will avoid audits, findings, fines, civil penalties, out-of-service orders, or other regulatory consequences.
Consult Counsel. Regulatory requirements change and vary by jurisdiction. Customer should consult qualified legal counsel and/or a DOT compliance professional before relying on Certflo output for any regulatory decision.
4. Accounts and Access
You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account. Each workspace is intended for use by a single motor carrier entity and its authorized personnel.
5. Pricing and Payment
The Service is billed at $29 per driver per month with a 5-driver minimum. A 3-day free trial is available with a valid credit card. Billing begins automatically at the end of the trial unless you cancel. The first 10 non-driver seats (branch manager, supervisor, dispatch) are included at no additional charge. Additional non-driver seats are billed at $9.99 per seat per month.
6. Cancellation
You may cancel your subscription at any time through the account billing page. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
7. Your Data
You retain ownership of all documents and data you upload to the Service. We do not sell, share, or use your data for purposes other than providing the Service. Upon account deletion, your data will be permanently removed within 30 days.
8. Acceptable Use
You agree not to use the Service to store, transmit, or process data that is unlawful, fraudulent, or harmful. You agree not to attempt to gain unauthorized access to other users' data, workspaces, or carrier records.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Mesquite Dev LLC makes no warranty that use of the Service will result in compliance with any law or regulation, or that Customer will avoid audits, findings, fines, civil penalties, out-of-service orders, or other regulatory consequences. In no event shall Mesquite Dev LLC be liable for any fines, civil penalties, regulatory assessments, or judgments imposed on Customer by any government agency or court, regardless of the cause. Mesquite Dev LLC's total aggregate liability under this Agreement shall not exceed the fees paid by Customer to Certflo in the twelve (12) months preceding the event giving rise to the claim.
10. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
